Oracle v. Google: Judge finds structure of Java APIs not copyrightable, renders jury infringement verdict moot

Thought the Oracle v. Google litigation fireworks were over? Well, if you weren't aware, during the copyright phase of the trial, the jury found that Google had infringed the structure, sequence and organization of Oracle's Java APIs. However, at the time, Judge Alsup had yet to evaluate the validity of Oracle's API copyright claims upon which that verdict was based. Today, Alsup found that Oracle's argument didn't hold water because it would expand the breadth of copyright holder's rights too far -- in essence, it would allow owners of software code to prevent others from writing different versions to perform the same functions. This ruling renders the jury's earlier infringement verdict moot, and gives Mountain View yet another courtroom victory. Despite this latest defeat, Oracle's sure to run the case up one more rung on the legal ladder, so let the countdown to the appeal begin.

N.J. Mayor, Son Arrested For Hacking Political Rival's Website

A New Jersey mayor has been arrested along with his son on charges they conspired to hack a Website calling for the mayor's ouster as part of a campaign to target the mayor's critics.

Felix Roque, mayor of the Hudson County town of West New York, and his son Joseph Roque were arrested Thursday for gaining unauthorized access to computers in furtherance of causing damage to protected computers, causing damage to protected computers, and conspiracy to commit those crimes. West New York is directly across the Hudson River from midtown Manhattan.

According to the FBI, in early February 2012, a Hudson County resident and public official anonymously created and moderated the Recall Roque Website, and posted commentary and criticism of the mayor and his administration. On Feb. 6, Mayor Roque and his son allegedly conspired to hack into the site and take it down, as well as to identify, intimidate and harass anyone they discovered was involved with it.

By the late afternoon of Feb. 8, 2012, Joseph Roque had successfully hacked into various online accounts used in connection with the recall Website and used that access to disable it, authorities said.

?In this case, the elected leader of West New York and his son allegedly hacked into computers to intimidate constituents who were simply using the Internet to exercise their constitutional rights to criticize the government,? U.S. Attorney Paul Fishman said, in a statement. ?We will continue to investigate and prosecute those who illegally hack into computers and disable Websites with the goal of suppressing the exercise of that right.?

According to the criminal complaint, the younger Roque contacted domain registrar Go Daddy and reset the password of the site's creator. Then on Feb. 8, he allegedly cancelled the domain name. Phone records show that the father and son were in contact during the time this was going on, authorities said.

Afterwards, the elder Roque is accused of using email messages he had access to in order to identify the people behind the site, and called a Hudson County government official claiming to have proof that the official was behind the site. The official in question has been identified by The Jersey Journal newspaper as Hudson County Freeholder Jose Munoz.

Over the course of several days, Mayor Roque called the site's creator as well as other people linked to the site on the phone in a campaign of harassment and intimidation, authorities alleged. In addition, he is accused in the complaint of asking other public officials to work with him to retaliate against them.

The conspiracy charge and the charge of gaining unauthorized access to a computer in furtherance of causing damage to protected computers are each punishable by a maximum of five years in prison and a fine of up to $250,000. The charge of causing damage to protected computers carries a maximum sentence of a year in prison and a fine of up to $250,000.

Back in February The Daily, the first iPad-only newspaper, published a report saying that Microsoft was working on a version of Microsoft Office for iPad, it was nearly complete, and they had even got some hands-on time with ?a working prototype? of the software.

This week the Boy Genius himself. Jonathan Geller of BGR, says he has learned from a reliable source that Microsoft is planning to release MS Office for the iPad and Android tablets ? and they?re aiming for a November launch.

Their source also claims to have seen Microsoft Office running on an iPad and mentions that the splash screen for it says ?Office for iOS? ? which suggests there would be an iPhone version as well.

If we knew some specific dates for when the new Windows 8 tablets will launch (if ever) then we might be able to start guessing how long afterwards Microsoft would see fit to allow their office suite on other mobile platforms.

If and when Microsoft Office comes to the iPad, I think it?s a clear win-win situation for Apple and Microsoft. For Apple it?s another premier productivity suite and some flagship apps (especially for many corporate iPad users) and for Microsoft it would be a huge boost for their leading software suite in the rapidly growing mobile arena.

Exactly a week ago, my very good friend and I wanted to hang out for happy hour.
We decided to go somewhere we've never been to, but was close to where we lived.
Both craving for some good comfort food and some adult beverages after a long work week,
we ended up going to a Columbian/Spanish Restaurant called Saoco
[means "something outstanding" or it could also mean a specific beverage].
My friend and I were so happy that we went to this "new to us" restaurant. ?We were both so pleased with the food, the drinks, dessert, atmosphere, and service. ?When everything is excellent, the whole experience makes it more memorable! ?It also means that we order one more extra drink.

The empanadas were yummy and crispy filled with potatoes and spicy beef. ?It was served with spicy hot sauce, which I could really drink because it was THAT good.

The platter of chicaron, platano, and arepa were good too with the spicy sauce. ?This is not for the faint of heart or for those counting calories because chicharon is practically a thick slab of bacon fried. ?Not something I eat all the time, but I do enjoy it when I do. ?No judging folks!

My friend and I ordered garlic chicken and shrimp. ?Super flavorful and delicious. ?Served with beans and white rice. ?Have to have both when eating Spanish food!

We ordered passion fruit and mango mojitos. ?It was TOO GOOD. ?We had one of each.
Tres leches. ?If you don't know what it is, look it up. ?You'll want one ASAP!

My friend and I pretty much stayed at the restaurant for a few hours. ?We lost track chatting but most of all enjoying our experience at Saoco. ?We plan on going back to try the other dishes in the menu and we already can't wait!

Since this weekend is a long weekend, I plan on relaxing and enjoying the extra day off.

J.R. Smith Arrested in South Beach


New York Knicks player and possible Rihanna boyfriend J.R. Smith was busted in Miami Beach late Thursday. There was a bench warrant out for his arrest.

Miami Beach police said Smith was arrested on a bench warrant for not having a valid driver’s license after a routine traffic stop and search for his name.

Details were not immediately available on what led police to stop Smith about 8:30 p.m., but he joins our celebrity mug shots gallery with this one:

Hernandez said that J.R. (real name Earl Joseph Smith) was taken to the Miami-Dade County jail, where officials said he bonded out early Friday.

Legal battles erupt over Dish Network's commercial-skipping DVR ...

When Dish Network debuted its new ?Hopper? DVR box for subscribers of its satellite television service, the assumption was that it would help grow the viewing audience ? not help people avoid the insanely long commercial breaks between recorded programs.

But the Hopper box actually does just that, Authops over the commercials, which prompted broadcast TV stations Fox NBCUniversal, and CBS to file lawsuits against Dish yesterday.

?We were given no choice but to file suit against one of our largest distributors, Dish Network, because of their surprising move to market a product with the clear goal of violating copyrights and destroying the fundamental underpinnings of the broadcast television ecosystem,? Fox said in a statement (PDF) to Dish. ?Their wrongheaded decision requires us to take swift action in order to aggressively defend the future of free, over-the-air television.?

But it gets better. Dish has also decided to file its own lawsuit to get approval for its DVR commercial-skipping technology. Dish?s suit also wants the courts to confirm that its DVR Hopper box does create unauthorized copies of broadcaster?s programing that violates copyrights.

In a statement (PDF), Dish Network SVP of Programming David Shull said ?consumers should be able to fairly choose for themselves what they do and do not want to watch. Viewers have been skipping commercials since the advent of the remote control; we are giving them a feature they want and that gives them more control.?

It?s hard to argue with Shull?s statement, because that majority of people probably do fast forward through the commercial breaks when given the chance. Commercial interruptions have only gotten longer in the last decade, and with the advent of ad-targeting technology available online, those same commercials seem even more out-of-place since they don?t know exactly who?s watching a program.

The main takeaway from all of this? Commercials are too long and don?t apply to the individual viewer. Rather than to continually force the viewing audience to fast forward, switch the channel, or play on their iPhone during a commercial, maybe broadcasters should just address the real issue ? make commercials more palatable.

The Ralphs supermarket chain is among those impacted by a plastic and paper bag ban approved Wednesday in Los Angeles. Many neighboring jurisdictions already have similar bans in place.

Withstanding a strong lobby from the plastic bag industry, the Los Angeles City Council on Wednesday overwhelmingly approved a ban on single-use plastic bags at checkout counters as well as a 10-cent fee on paper bags.

With a population of 4 million -- and using?an estimated 2.7 billion plastic bags each year --?Los Angeles becomes the largest city in the U.S. to enact a ban and?joins 47 other cities in California alone.?

"This is a tipping point" for banning plastic bags around the world, City Councilman Paul Koretz, a ban sponsor, declared just before the 13-1 vote.


The industry counters that the ban will be bad for the environment and health and will cost local jobs.

Reusable bags "are hazardous because consumers seldom wash them, and they have been found to transport bacteria," Mark Daniels, chair of the American Progressive Bag Alliance, told msnbc.com, citing a case earlier this month of girls getting norovirus from cookies left in a reusable bag.

"Plastic bags make up a fraction a percent of the litter stream," Daniels added, citing a 2009 litter survey. "A policy to target and ban one product will not address the root issue" of pollution.

City staff countered at Wednesday's meeting that 43 percent of Los Angeles' trash is plastic and that the largest component of that plastic is plastic bags at 19 percent.

Daniels added that "reusables cannot be recycled" but city staff insisted standards would be adopted to make that a requirement.

As for jobs, city staff noted that the 750 jobs at companies making plastic bags in the area are not in the city, but in the county.

Large stores are allowed to phase out plastic bags over six months and then provide free paper bags for another six months. Small retailers will have a year to phase out plastic.

After a year, retailers will be allowed to charge 10 cents for paper bags -- a "disincentive" designed to steer consumers to reusable bags.

The council did back away from also banning paper bags, which would have made it the only city to ban both plastic and paper.

Koretz said the city would study the issue again in two years to see whether the 10 cent fee was enough to reduce paper bags.

The city ban was modeled on one enacted by Los Angeles County, with a population of 10 million. A?state court is hearing an appeal in a lawsuit against the county ban after the plaintiffs, a plastic bag maker among them, lost a lower court ruling.

City Council members who supported the ban noted that the vote was about creating environmental awareness among Angelenos.

"Let's not stop with plastic bags," said Councilman Richard Alarcon.?

The ban will go into effect after a standard environmental review, which is expected to take four months.

You must turn on Voice Search and Google Goggles in your settings after signing into your Google account.

You can swipe back and forth between your search results and a single Web page. You can also use Google's preview for search results instead of the typical list view. Preview allows you to tap the side-by-side page icon in the upper right corner and get a series of large pages that you can swipe through. Finding text within a Web page is a snap as well ? tap the magnifying glass on the bottom (iPhone) or top?(iPad)?menu.?Type in your term and each instance will be highlighted for you. ??

Unfortunately, Google's redesigned search app missed an opportunity to bring real multitasking to iOS. Say you've launched?Gmail ?from the App screen and now want to check Reader for news. What is Your 'Relationship' with Alcohol? | genConnect

The title of her book, Drinking: A Love Story, by Caroline Knapp, succinctly captures the essence of the late Carolyn Knapp?s gradual descent into alcoholism. This end point lies at the far right end of the drinking spectrum, depicted below. In order to get to that final stage, however, Ms. Knapp had to first pass through two other areas that define problem drinking, including a large gray zone that until now has received little attention. This is the almost alcoholic zone, and helping people to identify at what point they may have slipped into this zone offers them an opportunity: pause, reflect, and ultimately to decide if they want to pursue solutions for turning back.

Three Kinds of ?Relationships?

One way that we have found useful in terms of thinking about the different zones in the above diagram is in terms of different degrees of relationship. Just as our interpersonal relationships can differ in terms of intensity, so can our ?relationship? with drinking. Moreover, these differences aren?t separated by sharp lines; rather, they tend to blend into one another. Let?s look at these different kinds of relationships.

Casual Friendship

People whose relationship with alcohol falls into this stage drink primarily in social settings. This is what we mean by ?normal social drinking.? It?s a glass or two of wine at a wine-and-cheese get-together among friends, a couple of beers at the Sunday afternoon football party with friends, or an occasional happy hour cocktail with people from work. If we do drink alone at this stage of use, it is not typically on a daily basis, and it involves only a drink or two in one sitting.

Social users never binge, and they are neither psychologically nor physically ?dependent? on drinking, for example, in order to overcome social anxiety. People have used alcohol socially?indeed, it has been called a ?social lubricant??for literally centuries. Drinking in this context is said to help people ?loosen up? or ?relax.? Indeed, in small quantities alcohol may do this. A glass of wine or a beer can take the edge off just about any common stress we may be feeling. It can lower our inhibitions just a bit (hence the term ?unwind?) and thereby facilitate social interaction. Negative consequences, of course, can occur at any stage of drinking, but they are relatively rare at this stage. Viewed in terms of a relationship, at this stage alcohol can best be thought of as a casual friend.

Serious Relationship

When we say we?ve gone from being casual friends with someone to having a ?serious relationship? with them we are implying a stronger connection. So it is with alcohol. In this second stage, a person has learned to use alcohol consistently for one of two reasons: either to create certain positive feelings (e.g., relaxation, euphoria) or else to avoid certain negative feelings (e.g., anxiety, loneliness).

This type of drinking is represented by the large gray area that we have defined as the almost alcoholic zone on the drinking spectrum. It is indeed a ?gray area? because, first, there is no sharp line that separates normal social drinking from becoming an almost alcoholic. Second, there are even degrees within that zone, with some people being much closer to true alcoholism than others.

Rather than stepping over a sharp line in the sand, a person gradually slips away from social drinking and into the almost alcoholic zone. At some point the symptoms and behavior patterns associated with being an almost alcoholic start to appear.

The man or woman who is developing a serious relationship with alcohol is someone who may begin to drink alone as well as socially. This is an important change in drinking behavior because as a person crosses that boundary from drinking mainly in social situations to increasingly drinking alone their relationship with alcohol gets serious. It?s no longer just a casual friend but rather a reliable ?buddy.?

Drinking at this stage represents an intentional and consistent effort to either pursue desirable emotional effects, to allow us to engage in certain behaviors, or to overcome negative emotions such as social anxiety and their consequences (shyness, self-consciousness). As time goes on and we come to rely on our ?buddy? alcohol, we can easily find ourselves drinking more consistently (and in larger quantities) than regular social drinkers. As a result we are more vulnerable to certain negative consequences, such as more frequent hangovers, unpredictable mood changes, or lack of concentration and mental acuity. If we move deeper into the almost alcoholic zone our bodies become less efficient a metabolizing alcohol with the result that we feel tipsy more quickly, which can lead us to behave in ways that later embarrass us, or make us more likely to fail a sobriety test after drinking the same amount that before wouldn?t have put us over the limit.

Commitment

This corresponds to the two areas at the far right of the drinking spectrum: alcohol abuse and alcoholism. These stages, which are associated with severe symptoms and consequences that qualify for a formal diagnosis, mark the end of the ?love affair.? At this stage drinking has progressed from being a serious relationship to the level of what could be called a commitment that the drinker has made with alcohol. Loved ones often relate very well to this idea of someone having made a commitment to drinking. By the time drinking has progressed to this stage they can see how that commitment is not only intimate (like a marriage) but is also one that begins to seriously compete with drinkers? other commitments?to spouses, children, friends and work.

The committed drinker makes sure that he or she is never far from alcohol. Over time, his or her life style begins to revolve around more and more around drinking. One husband described how his wife, as she moved into this stage of drinking, refused to go anywhere that she could not drink. She refused, for example, to take a bus tour with him to visit three national parks because she could not take liquor on the bus. And as one wife put it, ?My husband won?t go anywhere without his cooler. It?s as attached to him as his wedding ring.? If that last comment isn?t an image of commitment, we don?t know what would be!

Definite personality changes begin to appear as a person drifts into the commitment stage. In the emotional sphere, these changes most often include a growing emotional instability, increased aggressiveness and irritability, and depression. Psychologically, the habitual drinker becomes progressively more self-absorbed, unreliable, and demanding?in a word, childlike.

At this stage of drinking, significant others experience anger and anxiety as well as increasing frustration as repeated attempts to control the other person?s drinking fail. Confrontations over drinking may occur more frequently and come to threaten the stability of relationships with loved ones.

Once drinking has become a commitment, turning back and returning to normal social drinking is, in our experience, extremely difficult, if not impossible. If a committed drinker wants to do that we strongly recommend that he or she begin with an extended period of abstinence?six months at a minimum. The help of a counselor experienced with treating addictions is also essential. But we do not want to mislead anyone: turning back from a casual friendship is one thing, but turning back from a true commitment in another thing altogether.

Finally, Kessler tackles the contention from a ?select number of ?journalists?? that ?the new CBA is not much better than the proposal the owners made to the players in March of 2011,? calling that claim ?uninformed and wrong.?? Kessler?s letter represents the first detailed effort to respond to criticism of the CBA, but at no point does he or Foxworth address the comments from owners like Robert Kraft that, under the current labor deal, the salary cap won?t increase significantly for the foreseeable future.? The comparisons by ?journalists? like Daniel Kaplan of SportsBusiness Journal and Greg Bedard of the Boston Globe (and, yes, me) of the final CBA to the March 2011 proposal arose directly from projections and calculations regarding the cap dollars under the final deal in comparison to the guaranteed cap dollars under the March 2011 proposal.? No sign of breakthrough in U.N. atom chief's Tehran talks

VIENNA/DUBAI (Reuters) - The U.N. nuclear watchdog chief held rare talks in Tehran on Monday after voicing hope for a deal to investigate suspected atomic bomb research - a gesture Iran might make to try to get international sanctions relaxed and deflect threats of war.

International Atomic Energy Agency Director-General Yukiya Amano began discussions with the head of Iran's nuclear energy organization, Fereydoun Abbasi-Davani, a few hours after his pre-dawn arrival, according to ISNA news agency.

Amano, who was on his first trip to Iran since taking office in 2009, a period marked by rising tension between the IAEA and Tehran, was also due to meet Iran's chief nuclear negotiator, Saeed Jalili and Foreign Minister Ali Akbar Salehi on Monday. There was no word on the course of the talks by mid-afternoon.

"I really think this is the right time to reach agreement. Nothing is certain but I stay positive," Amano, a veteran Japanese diplomat with long experience in nuclear proliferation and disarmament affairs, said before departure from Vienna airport. He added that "good progress" had already been made.

But while Amano scheduled Monday's talks with Iran at such short notice that diplomats said a deal on improved IAEA access in Iran seemed near, few see Tehran going far enough to convince the West to roll back swiftly on punitive sanctions when its negotiators meet global power envoys in Baghdad on Wednesday.

"We are not going to do anything concrete in exchange for nice words," a Western diplomat said of the Baghdad meeting, the outcome of a big power session with Iran in Istanbul last month that ended a diplomatic freeze of more than a year.

Two days after seeing Amano, Jalili will hold talks in the Iraqi capital with Catherine Ashton, the European Union foreign policy chief heading a six-power coalition comprised of the five U.N. Security Council permanent members - the United States, Britain, France, Germany, Russia and China - plus Germany.

By dangling the prospect of enhanced cooperation with U.N. inspectors, diplomats say, Iran might aim for leverage for the broader talks where the United States and its allies want Tehran to curb works they say are a cover for developing atomic bombs.

Pressure for a deal has risen. Escalating Western sanctions on Iran's economically vital energy exports, and threats by Israel and the United States of last-ditch military action, have pushed up world oil prices, compounding the economic misery wrought by debt crises in many industrialized countries.

HOPE VIES WITH MISTRUST

Some diplomats and analysts said Amano, given a recent history of mistrustful relations with Iran, would go to Tehran only if he believed a framework agreement to give his inspectors freer hands in their investigation was close. Iran has been stonewalling IAEA requests for better access for four years.

"Amano would not have travelled to Tehran had he not been provided with assurances that progress could be made. If he returns to Vienna empty-handed, the embarrassment will be more damaging for Tehran than the agency," said Ali Vaez, senior analyst at the International Crisis Group.

"However, if the IAEA is satisfied with Tehran's cooperation, Iranian negotiators will have a new trump card to play at the negotiating table in Baghdad."

The U.N. watchdog is seeking access to sites, nuclear officials and scientists and documents to shed light on work in Iran applicable to developing the capability to make nuclear weapons, especially the Parchin military complex outside Tehran.

Two meetings between Iran and senior Amano aides in Tehran in January and February failed to produce any notable progress. But both sides were more upbeat after another round of talks in Vienna last week, raising hopes for a deal.

"We need to keep up the momentum. There has been good progress during the recent round of discussions between Iran and the IAEA," Amano said, stressing that he did not expect to visit Parchin during his short, one-day stay in Tehran.

"We regard the visit ... as a gesture of goodwill," Salehi said. He hoped for agreement on a "new modality" to work with the IAEA that would "help clear up the ambiguities".

DOUBTS

Yet while an Iranian agreement on a so-called "structured approach" outlining the ground rules on how to address the IAEA's questions would be welcome, it remains to be seen how and when it will be implemented in practice.

"We'll see if the Iranians agree to let the agency visit Parchin. I have my doubts, no matter what any agreement says on paper," said one Western envoy ahead of Amano's visit to Iran.

Such a deal would also not be enough in itself to allay international concerns. World powers want Iran to curb uranium enrichment, which can yield fuel for nuclear power plants or for nuclear bombs, depending on the level of refinement.

Iran, to general disbelief from its Israeli and Western adversaries, insists its nuclear program is intended only to generate electricity in a country that is one of world's top oil exporters and to produce isotopes for cancer treatment.

Unlike its arch-enemy Israel, assumed to harbor the Middle East's only nuclear arsenal, Iran is a signatory to treaties that oblige it to be transparent with the IAEA.

ISRAEL SCEPTICAL

Leaders of the Group of Eight, worried about the effect of high oil prices on their faltering economies, turned up the heat on Iran on Saturday, signaling readiness to tap into emergency oil stocks quickly this summer if tougher new sanctions on Tehran threaten to dry up supplies of crude.

Israel, convinced a nuclear-armed Iran would pose a mortal threat, has - like the United States - not ruled out air strikes to stop Iran's atomic progress if it deems diplomacy at an end.

Israel believes Iran is using the talks only to buy time.

In Baghdad, the powers' main goal is to get Iran to stop the higher-grade uranium enrichment it started two years ago and has since expanded, shortening the time needed for any weapons bid.

"What the powers are proposing right now is a kind of interim arrangement ... (but) this certainly is not sufficient to stop the military (nuclear) project in Iran," said Israeli Vice Prime Minister Moshe Yaalon.

"Our fear is that from Iran's perspective this is a sort of sacrifice of a pawn in a chess game in order to protect the king. We are not voicing satisfaction with this move, if it is the final move," he told Israel Radio.

Iran says it needs uranium enriched to a fissile concentration of 20 percent for its medical isotope reactor. Enrichment to 5 percent of fissile purity is suitable for power plant fuel, while 90 percent constitutes fuel for bombs.

The IAEA wants Iran to address issues raised by an agency report last year that revealed intelligence pointing to past and possibly ongoing activity to help develop nuclear explosives.

Iran says the intelligence is fabricated, and has so far resisted requests for inspectors to examine Parchin, maintaining that it is a purely conventional military installation outside the writ of nuclear inspectors.
